KCC 148/2016
This case involved an employee's entitlements on termination. The key issue was the final salary on which these entitlements should be calculated which was proven by figures in the employee's bank statements.
Background
An employee filed a case against a company before the commission of labour disputes settlement. He said that the company had failed to pay his financial entitlements after the termination of the contract. He requested the company to pay these entitlements. The case was then referred to the court.
The court ruled that the company should pay the employee 542.288 Dinars.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the court had established the ruling on the grounds that his salary was 60 Dinars although he had provided the court with the documents that proved that his salary was 100 Dinars and that it had been increased to 147 Dinars.
