This case involved the validity of the sentencing of an individual who had forged documents to unjustly obtain sick leave.

Background

The office of public prosecution accused a defendant of forging medical reports and stamps in order to receive sick leave from her job. The office requested the court to penalise the defendant according to the relevant laws.

The court suspended the announcement of the ruling on the condition that the defendant paid a guarantee of 500 Dinars and demonstrated good conduct for one year.

The office and the defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The office appealed the ruling before the court of cassation. The office said in its grounds of appeal that the ruling had insufficient evidence of causation. The office said that the court had applied Article 20(2) of Kuwait Law No. 1/1993 and then suspended the announcement of the ruling. The office said that the punishment issued against the defendant was not commensurate with the crime she had committed.
