KCC 1366/2016
This case involved an appeal against a firearms offence.
Background
The office of public prosecution accused a defendant of possessing firearms and ammunition without a licence. The office requested the court to penalise the defendant according to the relevant laws.
The court ruled that the defendant should pay a fine of 4000 Dinars. The court also ruled that the firearms and the ammunition should be confiscated.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that he had maintained before the court that the proceedings taken by the office of public prosecution had not been established upon valid investigations but the court had dismissed this defence.
