KCC 1346/2016
This case involved two individuals found guilty of drug offences and the right to appeal.
Background
The office of public prosecution accused two defendants of possessing two types of drugs for taking purposes. The office requested the court to penaliise the defendants according to the relevant laws.
The court ruled that the first defendant should be imprisoned for four years and that he should pay a fine of 1000 Dinars. The court ruled that the defendant should be deported from Kuwait after the ruling's execution. The court suspended the announcement of the ruling against the second defendant on the condition that he pay a guarantee of 500 Dinars and to demonstrate good conduct for one year.
The first defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The first defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the court had dismissed the appeal on the grounds that he was an irrelevant party though he had the right to appeal the ruling.
