KCC 11/2018
This case involved a request to terminate an investment contract and for a property to be vacated. There was a tenancy agreement in place but notice had been given.
Background
A claimant filed a case against a company before the court. He requested the court to dismiss an investment contract signed between the two parties. He also requested the court to order the company to vacate a rented property. He said that the company had rented the property from him to do business. He said that the agreed tenancy period was 38 months and that the two parties had agreed that the tenancy agreement would be renewed automatically at its termination unless one of the parties decided otherwise. He said that he had given notice to the company to vacate the property but they failed to do so.
The court ruled that the investment contract should be dismissed and that the company should vacate the rented property.
The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.
