KCC 1166/2016

This case involved whether the elements of the crime existed where individuals were accused of insulting the Emir in a demonstration.

Background

The office of public prosecution accused 13 defendants of insulting the Emir of Kuwait in a public demonstration. The office requested the court to penalize the defendants according to the relevant laws.

The court ruled that the defendants should be imprisoned for two years each and that the execution of the ruling should be suspended for three years on the condition that everyone should paid a guarantee of 3000 Dinars.

The office and the defendants appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.

The office and seven of the defendants appealed the ruling before the court of cassation. The defendants said in their grounds of appeal that the ruling had erred in the application of law. They said that the elements of the crime had not existed in their case.
