KCC 1121/2017
This case involved the legality of an agreement between a lawyer and a client that the lawyer would receive 10% of the amount the client gained in the litigation.
Background
A lawyer filed a case against a client before the court. He requested the court to order the client to pay him 6500 Dinars. He said that the client owed the amount as a result of the agreement signed between the two parties.
The court ruled that the client should pay the lawyer 6500 Dinars.
The client appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The client appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had established its ruling on the grounds of the agreement signed between the two parties although it violated Article 32 of Kuwait Law No. 42/1964 which amended by KuwaitLaw No. 62/1996.
