This case involved defendants who had been sentenced for drug offences then acquitted. These defendants should not have then been retried.
Background
The office of public prosecution accused two defendants of possessing drugs in order to take and trade. The office requested the court to penalize the defendants according to the relevant laws.
The court issued life sentences on the two defendants. The court also ruled that the defendants should be deported from Kuwait after the ruling execution.
The office and the defendants appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendants should be imprisoned for five years each and that they should pay a fine of 1000 Dinars each. The defendants and the office appealed the ruling before the court of cassation. The office said that the court had erred in the application of law and had insufficient evidence of causation.
