KCC 806/2016

This case involved whether there was solid evidence that a case involving payments on termination should be dismissed as the individual was not classed as an employee because evidence showed it was a shareholding company and the individual was the deputy chair of the board of directors.

Background

An employee filed a case against a company before the department of labour disputes settlement. He said that he was working for the company and that he had resigned from his job but the company had failed to pay his financial entitlements. He requested the company to pay these entitlements. The department referred the case to the court.

The court ruled that the company should pay the employee 28269.23 Dinars.

The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
