This case involved an employee who had been dismissed and was requesting his financial entitlements. The employee had not initially requested holiday pay and pay in lieu of notice so could not request them at this stage.
Background
An employee filed a case against a company before the court. He requested the court to order the company to pay him his financial entitlements. He said that the company had dismissed him from his job and had failed to pay these entitlements.
The court ruled that the company should pay the employee 57826.850 Dinars.
The two parties appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 127824.901 Dinars.
An employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said the court had failed to order the company to pay in lieu of notice and holiday pay although he deserved them.
