KCC 474/2016
This case involved whether there was suitable evidence of illegal possession of arms which had led to the closure of a shop and fines.
Background
The office of public prosecution accused three defendants of possessing hunting arms and ammunition without a licence. The office requested the court to penalize the defendants according to the relevant laws.
The court ruled that the first defendant should pay a fine of 2000 Dinars. The court also ruled that the first defendant’s shop should be closed for three months. The court ruled that the second and third defendants should pay a fine of 1000 Dinars each.
The first and second defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The first and second defendants appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law. They said that there was no solid evidence that they had committed the crimes.
Decision
The court said that this argument was invalid. The court said that the court had established the ruling on the grounds of solid evidence.
