KCC 40/2017

This case involved an individual sentenced for various drug offences and a firearms offence. A key issue was whether the ruling had been clear or ambigious.

Background

The office of public prosecution accused a defendant of possessing different types of drugs in order to take and trade in addition to alcoholic products. The office also accused the defendant of possessing firearm without licence. The office requested the court to penalize the defendant according to the relevant laws.

The office appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should be imprisoned for four years and pay a fine of 1000 Dinars for the second and fourth crimes. The court ruled that the defendant should be imprisoned for one year for the sixth crime and he should pay a fine of 1000 Dinars for the fifth crime.

The office appealed the ruling before the court of cassation.

Decision

The court dismissed the appeal against the appealed ruling in regard with the sixth crime and upheld the appealed ruling otherwise.

The defendant made a request asking the court of cassation to explain the ruling.
