KCC 974/2016
This case involved an individual who had used a formal document after it should have been used.
Background
The office of public prosecution accused a defendant of using a formal document after exhausting its legal power. The office requested the court to penalize the defendant according to the relevant laws.
The court ruled that the defendant should be imprisoned for two years and four months. The court ruled that the document should be confiscated.
The defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and suspended the announcement of the ruling upon the condition that the defendant should pay a fine 1000 Dinars and demonstrate good conduct for two years.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the court had failed to mentioned the laws according to which he was convicted and the evidence upon which the ruling was established.
