Background

A claimant filed a case against a restaurant owner and requested the court to order him to pay 5400 Dinars for rent for two months and the cost of insurance for one month. The claimant stated the owner had failed to commit to his obligations according to the contract.

The court ruled that the owner should pay the claimant 600 Dinars.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the owner should pay the claimant 5400 Dinars.

Decision

The owner appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had contradictions of material documentary evidence because the claimant had benefitted from the rented property but the court had ignored this fact.
