KCC 709/2016
This case involved a tenant's failure to pay rent. A key issue was whether the tenant should receive decoration expenses from the landlord when it was agreed the tenant should hand the properties over as they were before the contract was signed.
Background
A landlord filed a case against a tenant before the court. They requested the court to order the tenant to pay arrears of 12000 Dinars in addition to compensation of 20000 Dinars. They said that the tenant had rented two shops and failed to pay the rent.
The tenant filed a case against the landlord before the court. They requested the court to order the landlord to pay insurance of 10000 Dinars plus a deposit of 6000 Dinars and decoration expenses of 4000 Dinars.
The court ruled that the tenant should pay the landlord 10400 Dinars. The court ruled that the landlord should pay the tenant 6000 Dinars.
The landlord and the tenant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the tenant should pay 4400 Dinars and upheld the ruling otherwise.
