KCC 685/2016

This case involved a request by parties to a contract to register a property. The original contract did not contain this right and it was not possible to amend the terms.

Background

Two claimants filed a case against two companies before the court. They requested the court to order the companies to amend document No. 3939 on a disputed property by adding their share and to hand the document to them. They also requested the companies to pay the document fees.

The court said that the companies should amend the document according to the claimants’ request and pay the fees.

The two companies appealed the ruling before the court of appeal. The court upheld the appealed ruling.

The two companies appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had erred in the application of law. They said that the contract signed with the claimants did not give them the right to register the property.
