KCC 458/2016
This case involved the validity of an appeal which it had been filed after the time limit on a decision involving vacation of commercial premises. A key issue was the validity of the notification procedures.
Background
A landlord filed a case against a tenant before the court. They requested the court to order the tenant to vacate some rented shops and pay the arrears.
The court ruled that the tenant should vacate the rented shops and that they should pay the rent starting from 15/06/2015 until the point they vacated the premises.
The tenant appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
The tenant appealed the ruling before the court of cassation. They said in their grounds of appeal that the ruling had violated the right of defence. They said that the court had dismissed their appeal on the grounds that they had failed to submit it within the legal deadline although they had not been informed of the hearing dates and the date of the appealed ruling.
