KCC 455/2016

This case involve an individual accused of theft and forgery. They were acquitted of one of the crimes. The remaining crime was a minor crime so could not be appealed.

Background

The office of public prosecution accused a defendant of forging banking statements and seizing a victim’s money. The office requested the court to penalise the defendant according to the relevant laws.

The court acquitted the defendant from the first crime. The court ruled that the defendant should be imprisoned for one year. The court ruled that the defendant should pay a guarantee of 2000 Dinars in order for the ruling to be suspended.

The office and the defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should be imprisoned for three years.

The defendant appealed the ruling before the court of cassation.
