KCC 449, 470, 486/2016

This case initially involved two companies where one had failed to pay another for finished product work. Another claimant had intervened in the case and asked to be paid money by both companies who by this time had reached a settlement.

Background

A company filed a case against another company before the court. The company requested the court to order the other company to pay 470000 Dinars. The company said that they had finished a project for the company and that the company had failed to commit to their obligations according to the contract. Another claimant intervened in the case and requested the court to order the two companies to pay him 18175 Dinars and interest of 7%.

The court dismissed the claimant’s intervention. The court said that the two companies had reached a settlement agreement and approved this agreement.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the two companies should pay the claimant 53906 Dinars and interest of 7%.

Decision

The three parties appealed the ruling before the court of cassation.

The court said that the arguments of the three parties were invalid.
