KCC 416/2016
This case involved the validity of testimonies used to convict an individual of beating and threatening a victim.
Background
The office of public prosecution accused a defendant of beating a victim and threatening her. The office requested the court to penalize the defendant according to the relevant laws.
The court ruled that the defendant should be imprisoned for three and a half years. The court ruled that the defendant should pay a fine of 100 Dinars as well.
The office and the defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendant should be imprisoned for four years.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. He said that the testimonies of witnesses upon which court established the ruling had been invalid.
Decision
The court said that this argument was invalid. The court said that the court had been satisfied with the testimonies and that these testimonies had been valid.
The court dismissed the appeal and upheld the appealed ruling.
