KCC 268/2016
This case involved defendants who had injured an individual by beating them. A key issue was whether an appeal was possible.
Background
The office of public prosecution accused a defendant of beating the victim and causing damage to them The office also accused the second defendant of beating the first defendant. The office requested the court to penalize the defendants according to the relevant laws.
The court ruled that the first defendant should be imprisoned for two years and that he could pay a guarantee of 500 Dinars in order for the ruling to be suspended. The court ruled that the second defendant should pay a fine of 150 Dinars.
The defendants appealed the ruling before the court of appeal. The court dismissed the appeals and upheld the appealed ruling.

Decision
The court said that the argument made by the first defendant was invalid.
The court dismissed the appeal made by the second defendant. The court said that the ruling issued against the second defendant could not be appealed before the court of cassation according to Article 8 of t Kuwait Law No. 40/1972 .
