Background

An employee filed a case against a company before the court. He requested the court to order the company to pay his financial entitlements. He said that the company had dismissed him from his job without legal justification.

The court ruled that the company should pay the employee his financial entitlements including the arrears, holiday pay and pay in lieu of notice.

The employee and the company appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the holiday pay. The court amended the appealed ruling and ruled that the company should pay the employee 3011.537 Dinars.

The company appealed the ruling before the court of cassation. The company said in their grounds of appeal that the ruling had erred in the application of law. The company said that the court had ordered them to pay commission to the employee although he had not requested it..
