KCC 1838/2013

Background

A company filed a case against an insurance company and requested the court to pay an amount of money. The company stated it had paid compensation for a third party for the damage of goods and it had the right to claim the compensation amount from an insurance company.

The insurance company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The insurance company appealed the ruling and stated in its grounds of appeal that the ruling had erred in the application of law and that the court had rejected its argument that the company had no right to claim the compensation amount due to the statute of limitations in line with Article 201 of the Maritime Code.
