KCC 17/2016
This case involved the sentencing of two individuals who had beaten someone and damaged their car. A key issue was the impact of the victim having pardoned the first defendant on their sentencing.
Background
The office of public prosecution accused two defendants of beating a victim and damaging his car. The office requested the court to penalize the defendants according to the relevant laws.
The court ruled that the first defendant should be imprisoned for three years for committing the first crime and pay a fine of 50 Dinars for the second crime. The court ruled that the second defendant should be imprisoned for one month for committing the first crime and pay a fine of 50 Dinars for the second crime.
The first defendant made an objection to the ruling. The court amended the ruling and ruled that the first defendant should be imprisoned for one year and that he could pay a guarantee of 500 Dinars for the ruling to be suspended.
The two defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
