Background
The office of public prosecution accused four defendants of broadcasting a TV programme in violation of a publishing ban. The office said that the defendants had also expressed opinions that threatened civil stability and insulted the judicial authorities. The office also accused another defendant of participating in the crimes and insulting the public prosecutor. The office requested the court to penalize them according to the relevant laws.
The court acquitted the first four defendants. The court ruled that the fifth defendant should be imprisoned for six months. The court suspended the execution ruling against the fifth defendant in the second crime on the condition he paid 1000 Dinars.
The office and the fifth defendant appealed the ruling before the court of appeal. The court dismissed the office’s appeal. The court dismissed the appealed ruling issued against the fifth defendant and acquitted him.
The office of public prosecution appealed the ruling before the court of cassation.
