Background
The office of public prosecution accused a defendant of possessing firearms and ammunition and of ammunition trading. The office requested the court to penalise the defendant according to the relevant laws.
The court suspended the announcement of the ruling on the grounds that the defendant had paid a guarantee of 2000 Dinars and would demonstrate good conduct for two years. The court also ruled that the firearms and the ammunition should be confiscated.
The defendant and office appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the defendant should pay a fine of 5000 Dinars. The court also ruled that the firearms and the ammunition should be confiscated.
The defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had violated the right of defence. He said that the investigation conducted by the police were not serious.
