KCC 511/2012

This case involved a claim by an employee for unpaid salary against two companies. One of the companies tried to claim it had no employment relationship with the employee. A document it had issued referring the employee to a medical centre was used to prove such a relationship existed.

Background

An employee made a complaint against two companies before the Labour Department and requested the department order the employee to pay his salary. The department referred the case to the court.

The court ruled that the companies should pay the employee 7752 Dinars.

The first appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the appeal.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law because the court had established its ruling based on the argument that a working relationship is not exist between the employee and the first company although the case documents included two documents in which the companies endorsed this relationship.
