Background

A claimant filed a case against a defendant and requested the court to order the administrative body which the defendant represented to pay compensation for the damage which had resulted from the claimant's dismissal from work.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the defendant should pay the claimant 2000 Dinars.

Decision

The defendant appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and the court had established its ruling based on a previous ruling which had confirmed that the claimant had caused part of some damage.

The court stated this argument was valid because the case documents revealed that the claimant had participated in the circumstances which resulted in the dismissal decision.

The court repealed the ruling.
