Employee’s Dues – Expert – Evidence – Endorsement
This case involved a claim by an employee for his dues. The case was rejected after the expert proved the employee had endorsed he had given up the case.
Background
An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.
The court ruled that the company should pay the employee 13006.454 Dinars.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The company appealed the ruling before the court of cassation.
The company repealed the ruling and referred the case to an expert. The expert stated the representative of the company had provided him with a document in which the employee had endorsed that he had given up his case against the company.
The court abandoned the appealed ruling and rejected the case.
