KCC 1901/2013

This case involved a request by an employee for his service time to be altered. The request was rejected as the plea had not been filed within the legal time limits.

Background

A claimant filed a case against an institution and requested the court to re-register him with this institution for the period of his service which was 26 years and 4 months and appoint an expert in order to determine the actual date of his appointment.

The court ruled that the institution should add the period from 31/05/1982 to 05/07/1984 to the claimant's actual service period.

The institution appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law because the claimant had failed to make his plea within the legal deadline and so his appeal should be rejected.

The court stated this argument was valid because the case documents had revealed that the claimant had failed to introduce his plea within the legal deadline.

The court repealed the ruling.
