KCC 9/2012

This case involved whether criminal intention existed in the case of a woman convicted of killing. It was within the court's authority to evaluate her mental health.

Background

An appellant said in her grounds of appeal that the appealed ruling by which she was convicted of killing had insufficient evidence of causation and had violated the right of defence. The court said that the court established the ruling on the grounds of the reasons of the elementary ruling. She said that she had maintained before the court that her confession was invalid due to the physiological illness she suffered from and that the criminal intention did not exist due to the same reasons but the court dismissed this defence.
