KCC 967/2012

This case involved an administrative decision which had denied an employee promotion. The court had been wrong as the employee had the necessary grade in their assessment and this had been signed by their line manager.

The documents of the case revealed that the court had dismissed the decision of the administrative authority in which it refused the promotion of the litigant.

Decision

The court said that the authority had established its decision on the grounds that the litigant did not receive the  “Excellent” grade in their employee assessment and the report was not signed by the litigant's direct manager. The court said that the litigant provided the court with documents which confirmed that he had received the “Excellent” grade and that the report was signed by his direct manager. The court said that the report therefore met the legal conditions and that the defence made by the administrative authority was irrelevant in this regard.

The court dismissed the appeal.
