KCC 794/2011
This case involved the statute of limitations which applied on a housing allowance claim which was related to a constitutional court ruling.
Background
The documents of the case revealed that the court had dismissed the claim made by the appellant for a housing allowance due to the statute of limitations.
Decision
The court said that the court established its ruling on the grounds that the appellant made her claim on 26/05/2009 and that the constitutional court issued the ruling which related to the subject of the claim on 07/10/2007 and that the ruling was published in the official gazette. The court said that the period of limitation started from the date the ruling was published. The court said that the appellant's defence that her case did not fall under the rules of the ruling was irrelevant.
The court dismissed the appeal.
