This case involved whether an individual could be convicted of indecent assault based on a confession when the content of this testimony had not been indicated in the court.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of indecent assault had insufficient evidence of causation. He said that the court established its ruling on the grounds of the victim's testimony only though it failed to indicate the content of this testimony.

Decision

The court of cassation said that this argument was valid. The court said that the documents of the case revealed that the court had established its ruling on the grounds of the victim's confession. The court said that the court, however, failed to indicate the content of this testimony. The court said that the court therefore established its ruling on an invalid base.

The court repealed the ruling.
