The documents of the case revealed that the court concluded that the litigant occupied the financial position “B” and that the appellant occupies the financial position “A”.

The court said that the former deserved the latter's position according to the decision of the council of the civil service Kuwait Decision No. 18/2010. The court said that the court had established its ruling on the grounds that Kuwait Decision No. 1084/2012 by which the appellant was promoted to the mentioned position was illegal. The court said that the court established its ruling on the grounds of solid evidence and that the appellant's defence was irrelevant in this regard.

The court dismissed the appeal.
