KCC 690/2013

This case involved the validity of a confession, arrest and investigation procedures in a case where an individual was convicted of a drug offence and drink driving.

Background

An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of possessing drugs for taking and trading purposes and driving a car under the influence of alcohol had insufficient evidence of causation and had erred in the application of law. He said that he had maintained before the court that the inspection proceedings were invalid but the court dismissed this defence. He also maintained before the court that he was forced to make his confession but the court dismissed this defence as well.
