Bounced cheque - Guarantee - Dated
This case involved whether a cheque should be classed as a bounced cheque when it was issued as a guarantee and had not been dated by the issuer.
Background
An appellant said in their grounds of appeal that the appealed ruling by which they were convicted of issuing two bounced cheques had insufficient evidence of causation and had erred in the application of law. They said that they issued the cheques as a guarantee for a commercial transaction with the complainant. They said that the cheques did not include the due dates and that the complainant wrote the dates and therefore the cheques did not meet the conditions stipulated by Article 511 of the Law of Commerce.
