Witness - Self Defence - Assault
This case involved an assault. Self defence could not be claimed for the first time before the court of cassation. It also looked at the authority to assess witness statements.
Background
An appellant said in his grounds of appeal that the appealed ruling by which he was convicted of beating someone and this caused damage, threats and insults had insufficient evidence of causation and had erred in the application of law. He said that the court had failed to indicate the aspects of the incident and the evidence on the grounds of which it had established the ruling. He also said that he had maintained before the court that he was acting in self-defence at the time of incident.
