KCC 492, 571/2014
This case involved whether an arbitration ruling could be appealed or dismissed. A key point was whether the company had signed a contract with an arbitration clause and if the ruling was invalid as it was issued outside the arbitration period.
Background
The question arose as to whether an arbitration ruling could be appealed.
Decision
The court of cassation said that the relevant laws stipulated that an arbitration ruling could not be appealed as a general rule. The court said the relevant laws, however, stipulated that the relevant parties could request the dismissal of the arbitration ruling in special cases. The court said that the documents of the case revealed that the court had dismissed the request for dismissing the arbitration ruling on the grounds that the company had signed the contract which had an arbitration condition. The court also dismissed the defence that the arbitration ruling was issued after the period of arbitration was finished on the grounds that the committee of arbitration decided to extend the period of arbitration in accordance with the arbitration contract.
The court dismissed the appeals.
