KCC 451/2013

This case involved an individual arrested for a drugs offence and drink driving. A key point was whether the arrest and inspection proceedings were invalid.

Background

An appellant said in his grounds of appeal that an appealed ruling by which he was convicted of possessing drugs for taking purposes and driving a car under the influence of alcohol had insufficient evidence of causation had erred in the application of law. He said that the inspection and the arrest proceedings were invalid but the court dismissed this defence. He also said that the report of criminal laboratory proved that no alcohol existed in his blood at the time.
