Background
An appellant appealed the ruling before the court of cassation and provided the court with a document in which the victim had ceded his right in the case.
Decision
The court of cassation said that Article 240 and 241 of Kuwait Law No. 17/1960 stipulated that the victim has the right to cede his case against the convicted person in the crimes of assault including the crime stipulated by Article 162(2) of Kuwait Law No. 16/1960. The court said that due to the close relationship between the two parties, the court would validate the reconciliation agreement reached by them.
The court repealed the ruling and dismissed the appealed ruling.
