This case involved whether it was possible to appeal a misdemeanour case.

An appellant appealed the ruling before the court of cassation.

Decision

The court of cassation considered issues which related to the public order. The court said that Article 8 of Kuwait Law No. 40/1972 stipulated that the ruling issued in misdemeanours cases cannot be appealed before the court of cassation unless the misdemeanour is strongly connected with a crime in a way that the two cases cannot be partitioned. The court said that the misdemeanour of which the appellant was convicted was not related to the other crime he was accused of and was now considered by the court.

The court dismissed the appeal.
