KCC 263/2013

This case involved whether amounts were outstanding for the sale of goods. The amounts had been paid in instalments so it was irrelevant that some money had been paid. The court could decide which witnesses it was satisfied with.

Background

The court of cassation said that the documents of the case revealed that the court was satisfied with the testimonies of the litigant's witnesses that the appellant had bought jewellery from the litigant according to the bills provided. The court said that the court concluded from these testimonies that the appellant used to pay the value of jewellery in instalments and that still owed 62020 Dinars to the litigant. The court said that the appellant's defence that the court had failed to listen to her witnesses and that she paid some amounts of money to the litigant was irrelevant in this regard. The court said that the court established its ruling on the grounds of solid evidences including the report of expert and the bills provided by the litigant.
