KCC 2462/2013

This case involved a shop which was rented in order to sell gifts and accessories. A key point was whether compensation was due after the local authority refused to renew the commercial licence.

Background

The documents of the case revealed that the appellant had rented a shop from a company in order to sell gifts and accessories.

Decision

The court said that the appellant agreed that she should receive the required licences from the relevant authority in order to open the shop. The court said that the documents of the case revealed that the appellant had obtained a licence from the Ministry of Commerce but she failed then to renew the licence due to a rejection of the local council. The court said that the failure of the appellant to obtain a new licence was a result of the decision of the local council and therefore the company had nothing to do with this issue. The court said that the appellant therefore did not have the right to claim the value of compensation for damage from the company.

The court dismissed the appeal.
