KCC 2406, 2457/2013

Background

The court of cassation said that the documents of the case revealed that the court had concluded that the company (the appellant) owed 153000 Dinars to a company according to a contract for supplying water which was signed between the two parties.

Decision

The court said that the court dismissed the company's request for compensation for the car the company claimed that it had lost in Iraq because the court concluded that the car did not leave Kuwait. The court also said that the court dismissed the company's request for compensation for delay in the execution of the contract because the documents of the case revealed that it had failed to prove the damage had resulted. The court said that the court established its ruling on the grounds of solid evidence and that the company's defence was irrelevant in this regard.

The court dismissed the appeal.
