KCC 230/2013
This case involved the impact of a reconcilation where money was owed to a company. A key point was evidence had not been provided to the court that the money had actually been paid already.
Background
The court of cassation said that the court had dismissed a case on the grounds that the appellant still owed an amount of money to a company. The court said that the appellant and the company had reached a reconciliation agreement which stipulated that the former should pay the latter the amount. The court said that the documents of the case, however, revealed that the appellant had failed to provide an evidence that the mentioned amount had already paid. The court said that the evaluation of the contracts signed between the disputed parties fell under the authority of the court. The court said that the court established its ruling on solid evidence.
Decision
The court dismissed the appeal.
