KCC 2200/2014
This case involved grounds for a reservation. A previous ruling had ruled a debt existed and the company owed this debt independently from its partners.
Background
The court dismissed a case on the grounds that the documents of the case included all the details about issues related to the reservation.
Decision
The court of cassation said that the court had dismissed the case on the grounds that the documents of the case had included all the details about the issues which related to the reservation. The court said that the documents of the case revealed that a previous ruling was issued against the company and concluded that it still owed an amount of money to a debtor. The court said that the debt had a certain value and the dispute over it was settled. The court said that the company therefore was obliged to pay the value of debt as it had an independent financial liability from the partners who owned it. The court said that the court established its ruling on the grounds of solid evidence and that the company's defence was irrelevant in this regard.
The court dismissed the appeal.
