KCC 2076/2012

This case involved a timeshare contract. A key point was who was the relevant party in the case. Although the contract had been signed with an agent as they had not explained their status to the purchaser they remained liable.

Background

A claimant filed case against a company before the court. He requested the court to order the company to pay an amount of money and compensation. He also requested the court to dismiss the contract agreed with the company. He said that he had signed a contract with the company in order to buy the right to benefit from a resort in Lebanon for one week but they had failed to commit to its obligations. The claimant then added the judicial liquidator of the company to the case.

The court ruled that the company should pay the claimant the mentioned amount of money and compensation. The court ruled that thecontract should be dismissed.

The company and the liquidator appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case because it was filed against andirrelevant party.
