KCC 1857/2011
This case involved a debt. The key issue was whether as the principal case had been deleted payments should still be due under the second case.
Background
The documents of the case revealed that the court had deleted the principal case, however, it had ordered the litigant to pay an amount of money in the second case.
Decision
The court said that as the litigant had appealed the ruling and requested the court to dismiss the appealed ruling on the grounds that they were not informed about the debt, this meant that they maintained that the appellant did not deserve the mentioned amount. The court said that the documents of the case revealed that the litigant had paid the appellant 20500 Dinars in total. The court said that the appellant had failed to prove otherwise. The court said that the court established its ruling on solid evidence.
The court dismissed the appeal.
