KCC 1835/2012
The initial dispute involved an amount due for non-performance of a contracting contract. A key point was what should have if one of the appellants requests had not been considered by the court.
Background
A company filed a case against another company before the court. The company requested the court to order the other company to pay 13625 Dinars and legal interest of 7%. The company said that they had failed to commit to an agreed contracting contract.
The court ruled that the company should pay the company 13625 Dinars.
The two companies appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the payment of the legal interest and ruled that the second company should pay them.
The second company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the appealed ruling had insufficient evidence of causation. The company said that although the court considered the two appeals t it failed to accept its appeal in form. The court said that the court had failed to consider its defence.
